Terms of Use

These Terms of Use are a binding agreement between you (personally or on behalf of an entity) and Delovantage Corp Private Limited, trading as Delovantage AI Labs (the "Company", "we", "us", or "our"), governing your access to and use of delovantage.com and any dataset you license through us. By accessing the site, or by accepting a data licensing agreement with us, you agree to be bound by these terms. If you don't agree, don't use the site or license our data.

These Terms cover the delovantage.com website itself. A dataset you license from us — including multimodal captures, sensor data, annotations, metadata, and delivery formats described on our homepage — is governed primarily by the specific licensing agreement (exclusive or non-exclusive) you sign with us, which sets the price, scope, and usage rights for that dataset. Where these Terms and a signed licensing agreement conflict on dataset usage, the licensing agreement controls.

• A license grants you the right to use the delivered dataset for the purpose stated in your agreement (e.g. training or evaluating a machine learning model).
• Non-exclusive licenses do not grant ownership — the same dataset (or portions of it) may be licensed to other customers.
• Exclusive licenses restrict us from licensing that specific dataset to anyone else for the term agreed, but do not transfer copyright to you unless your agreement says so explicitly.
• You may not attempt to re-identify any individual who appears in the footage, nor redistribute, resell, or sublicense raw or annotated data outside the scope of your agreement.
• You may not use the data to build a product whose primary purpose is republishing or reselling the footage itself, rather than using it to train or evaluate a model.

Unless otherwise indicated, the site itself — including its code, design, text, and graphics — and the Delovantage and Delovantage AI Labs names, logos, and brand assets are owned by or validly licensed to Delovantage Corp Private Limited and are protected by applicable intellectual property laws. You're granted a limited license to view the site for your own information; you may not copy, republish, or commercially exploit site or brand content without our written permission.

As between you and the Company, and subject to participant privacy and personality rights, third-party rights, and any signed agreement that states otherwise, raw captures, derived datasets, annotations, labels, metadata, schemas, and related deliverables are owned by or validly licensed or assigned to Delovantage Corp Private Limited. A customer receives only the usage rights expressly granted in its signed licensing agreement. We do not claim ownership of personal information as such, and nothing in these Terms limits rights that individuals retain under applicable privacy or data-protection law.

By using the site or requesting data, you represent that:

• Information you submit (contact form, licensing agreement) is true, accurate, and current
• You have legal authority to enter into a licensing agreement on behalf of your organization, if applicable
• You will not access the site through automated scraping, bots, or similar means
• Your use of any licensed dataset complies with applicable law, including data protection and AI regulation in your jurisdiction

You agree not to:

• Systematically scrape or compile site content without our written permission
• Attempt to re-identify, contact, or track down any individual appearing in a licensed dataset
• Circumvent or interfere with security features of the site or any data-delivery system we use
• Use the site or our data for any unlawful purpose
• Misrepresent your identity or organization when requesting a dataset or license

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the site or a licensed dataset. Our total liability for any claim relating to a specific licensing agreement is limited to the amount you paid under that agreement in the twelve months before the claim arose.

You agree to indemnify us against claims arising from your breach of these Terms or of a signed licensing agreement — including misuse of a dataset outside its licensed scope, or an attempt to re-identify a capture participant.

We may update these Terms from time to time; the date at the top of this page reflects the latest revision. Continued use of the site after a change means you accept the update. Signed licensing agreements are only modified by mutual written agreement, not by a change to this page.
